Terms and Conditions
§ 1 Scope of Application
These General Terms and Conditions apply to all services and sales of products between the hair salon Friseur Janett Heinrich
(Owner: Sylvia Janett Heinrich, Partida Barranquets Calle 17A No. 5, 03779 Els Poblets, Alicante, Spain)
– Friseur Janett Heinrich – and the customer.
Any differing terms and conditions of the customer shall not be recognized unless expressly agreed to in writing by the salon.
§ 2 Appointments and Service Contract
Appointments are bindingly agreed upon in person, by telephone at +34 689 852 995, by email, or via other communication channels.
By making an appointment, a service contract is concluded.
The customer is obliged to appear punctually at the agreed appointment. In the event of lateness, the appointment may be shortened or canceled if proper performance of the service is no longer possible.
§ 3 Cancellations and No-Show Fees
Appointments may be canceled or rescheduled free of charge up to 24 hours before the agreed appointment.
In the event of late cancellation, significant delay, or failure to appear (no-show), the salon is entitled to charge a cancellation fee of up to 50 percent of the price of the booked service.
For extensive or time-intensive appointments, such as color treatments combined with cutting, the fee may amount to up to 100 percent of the agreed price, provided the appointment could not be reassigned.
The fee serves as compensation for lost income and incurred costs.
§ 4 Prices and Payment
The prices applicable on the day of service apply. These are communicated in advance in writing or by telephone, displayed in the salon, or available on the website https://friseurjanett.com/.
All prices include the statutory value-added tax (IVA in Spain).
Additional effort, for example due to particularly long, thick, or heavily pre-treated hair, may result in price surcharges. The customer will be informed in advance.
Payment is due immediately after the service and may be made in cash, by card, or by other agreed means.
Sold products, such as hair care items, are excluded from exchange or return unless statutory warranty rights apply or the product is defective.
§ 5 Service Performance and Complaints
The salon provides its services professionally and to the best of its knowledge and ability.
A specific result cannot be guaranteed, as it depends on individual factors such as hair type, previous treatments, and home care.
Complaints must be reported immediately and preferably during or directly after the treatment on site so that appropriate corrective action can be taken.
After leaving the salon, there is no entitlement to a refund, provided the salon was given the opportunity to remedy the issue.
The customer is obliged to inform the salon of any allergies, intolerances, or special hair conditions, such as previous treatments, prior to the service.
§ 6 Liability
The salon shall not be liable for damage to clothing, accessories, or personal belongings of the customer unless caused by intentional or grossly negligent conduct on the part of the salon.
The salon shall be liable for damages caused by intent or gross negligence in accordance with statutory provisions.
The customer shall be liable for any damage caused by them within the salon.
§ 7 Data Protection
The salon processes personal data in accordance with the privacy policy on the website and the applicable data protection regulations, in particular the GDPR and Spanish data protection law.
The competent supervisory authority is the Agencia Española de Protección de Datos (AEPD).
§ 8 Final Provisions
Should any provision of these General Terms and Conditions be or become invalid, the remaining provisions shall remain unaffected.
The law of the country in which the salon is established shall apply (Spain).
Place of jurisdiction is Alicante, insofar as legally permissible.
Changes to these General Terms and Conditions will be displayed in the salon or published on the website.
